§ 38-207. Illicit discharges.

  • (1)

    A person commits an offense if said person introduces or causes to be introduced into a storm sewer system located within the city, a discharge that is not composed entirely of stormwater.

    (2)

    It is an affirmative defense to prosecution that such discharge was composed entirely of stormwater and was one or more of the categories of discharges allowed pursuant to TPDES General Permit No. TXR150000 or an alternative TPDES permit issued by the TCEQ, or its successor.

    (3)

    A person commits an offense if said person discharges any stormwater into a storm sewer system located within the city that contains a pollutant or any substance which causes, continues to cause, or will cause pollution.

    (4)

    A person commits an offense if said person introduces or causes to be introduced a pollutant or any substance which causes, continues to cause, or will cause pollution into a storm sewer system located within the city.
